Terms and Conditions for JBC Logistics

1. Definitions

  • “JBC Logistics” refers to JBC Logistics, a tilt tray operator based in Mackay, Queensland, Australia.
  • “Client” refers to any individual or entity engaging JBC Logistics for transportation or related services.
  • “Goods” refers to items transported by JBC Logistics under these terms.
  • “Services” refers to tilt tray transportation, loading, unloading, and related logistics services provided by JBC Logistics.

2. Acceptance of Terms

By engaging JBC Logistics for services, the Client agrees to be bound by these Terms and Conditions. These terms apply to all bookings, contracts, and services unless otherwise agreed in writing by JBC Logistics.

3. Services

  • JBC Logistics provides tilt tray transportation services for goods within and from Mackay, Queensland, Australia, subject to availability and scheduling.
  • Services include loading, transporting, and unloading goods as agreed with the Client.
  • JBC Logistics reserves the right to refuse service if goods are deemed unsafe, illegal, or exceed vehicle capacity or legal limits.

4. Bookings and Cancellations

  • Bookings must be made in advance via phone, email, or other designated methods, specifying the nature, weight, and dimensions of goods.
  • Cancellations by the Client within 24 hours of the scheduled service may incur a cancellation fee of 50% of the quoted price.
  • JBC Logistics may cancel or reschedule services due to unforeseen circumstances (e.g., vehicle breakdown, weather conditions) with notice to the Client.

5. Pricing and Payment

  • Quotes are provided based on the weight, dimensions, distance, and nature of goods, and are subject to change if details are inaccurate.
  • All prices are in Australian Dollars (AUD) and include GST unless stated otherwise.
  • Payment is due within 7 days of invoice issuance unless otherwise agreed in writing.
  • Late payments may incur a fee of 2% per month on outstanding balances.
  • Additional charges may apply for waiting time, special permits, or unexpected delays caused by the Client.

6. Client Responsibilities

  • The Client must ensure goods are properly packed, secured, and labeled for transport.
  • The Client must provide accurate details of goods, including weight, dimensions, and any hazardous properties, in compliance with Australian laws.
  • The Client is responsible for obtaining any necessary permits or approvals for the transport of goods.
  • The Client must ensure safe access to loading and unloading sites, free of obstacles and hazards.

7. Liability and Insurance

  • JBC Logistics will exercise reasonable care in handling and transporting goods but is not liable for loss, damage, or delay caused by:
    • Acts of God, weather, or natural disasters;
    • Inadequate packaging or incorrect information provided by the Client;
    • Inherent defects or fragility of goods.
  • JBC Logistics maintains standard carrier liability insurance. Additional insurance for high-value or fragile goods is the Client’s responsibility.
  • Any claim for loss or damage must be submitted in writing within 7 days of delivery, with supporting evidence.

8. Hazardous Goods

  • The Client must notify JBC Logistics in advance if goods are hazardous, dangerous, or regulated under the Australian Dangerous Goods Code.
  • JBC Logistics reserves the right to refuse transport of hazardous goods if safety or compliance cannot be ensured.

9. Delivery and Delays

  • Delivery times are estimates only and subject to traffic, weather, and other factors beyond JBC Logistics’ control.
  • JBC Logistics is not liable for delays or consequential losses arising from late delivery.

10. Subcontracting

  • JBC Logistics may subcontract part or all of the services to third parties at its discretion, ensuring subcontractors adhere to these terms.

11. Compliance with Laws

  • All services are performed in compliance with Australian laws, including the Heavy Vehicle National Law and Queensland transport regulations.
  • The Client warrants that goods and activities comply with all applicable laws and regulations.

12. Termination

  • JBC Logistics may terminate services immediately if the Client breaches these terms, fails to make payment, or engages in illegal activity.
  • Upon termination, any outstanding fees remain payable by the Client.

13. Dispute Resolution

  • Any disputes arising under these terms will be resolved through negotiation in good faith.
  • If unresolved, disputes will be subject to the jurisdiction of the courts of Queensland, Australia.

14. Amendments

  • JBC Logistics reserves the right to amend these Terms and Conditions at any time, with updated terms effective upon notification to the Client or posting on the JBC Logistics website.
